Dan has over 16 years of legal experience, specialising in defending regulatory and criminal investigations and prosecutions brought by a wide range of regulators.
Regulatory work: In respect of regulatory proceedings he has acted in cases brought by the Health & Safety Executive (including fatalities), Financial Conduct Authority (and previously the Financial Services Authority), Office of Fair Trading and the Environment Agency in relation to issues including food safety, waste packaging, advertising and trade descriptions, age restricted products, licensing, weights and measures, product liability including toy safety and gang-masters issues.
He has also provided proactive advice to clients to ensure they do not breach health and safety legislation in the course of their business.
Business/white collar crime: He has also defended in some of the largest criminal prosecutions brought in the UK including matters investigated and prosecuted by the Police, CPS, HM Revenue & Customs and Business Innovation and Skills. He has also acted in a number of high profile investigations and prosecutions brought by the Serious Fraud Office. Such work includes long firm fraud, MTIC, high yield investment fraud, insurance and mortgage fraud, asset stripping and advance fee fraud.
Compliance: Dan is uniquely placed to advise in a non-contentious capacity having spent many years defending cases brought by law enforcement and other regulators. He has advised in respect of the full range of regulatory matters from criminal/regulatory liability issues including anti-money laundering. He has also provided bribery and corruption advice. This work has involved advising professionals including solicitors and accountants on their obligations when faced with, for example: production orders including related issues of legal professional privilege, witness summons for documents and attendance at court and money laundering including advice on the need to make suspicious activity reports.
Counter fraud advice and internal investigations: One of Dan’s particular interests is the internal investigation of fraud related crime and/or malpractice within corporate organisations by employees and/or external third parties (for onward referral to law enforcement and/or passing to civil litigators for civil recovery proceedings). Dan qualified as an Accredited Counter Fraud Specialist in May 2015.
Examples of this type of work include anti-bribery policy creation, business bribery risk assessment, staff training, suspicious activity investigations (referral to the police or civil recovery where appropriate).
