Draft ACAS guidance on new disciplinary and grievance Code of Practice published

ACAS has published draft guidance to accompany the new Code of Practice that is expected to come into force in April 2009 which sets out good practice for dealing with discipline and grievances in the workplace.
When the statutory dispute resolution procedures are repealed next year employers will be expected to follow a new ACAS Code of Practice on discipline and grievance at work (the Code). A draft Code was published for consultation in May. Although the Code will not be mandatory, employment tribunals will be able to take into account any failure to follow the Code in an unfair dismissal case and will be able to adjust any compensation awarded by up to 24% where the Code has not been followed.
ACAS has now published complementary guidance to accompany the Code which sets out good practice for dealing with discipline and grievances in the workplace. This will not form part of the Code itself and will have no status at an employment tribunal but it is useful because it is based on ACAS’ extensive experience of how discipline and grievances in the workplace should be handled.
The guidance is long at 74 pages but,there is a useful appendix providing information on dealing with all types of absence, including how to handle:
- persistent short-term absence
- long-term absence through ill health
- specific health problems
- failure of an employee to return from extended leave on an agreed date
