TUPE
The Transfer of Undertakings (Protection of Employment) Regulations 2006, known in the trade as “TUPE”, can strike fear into the heart of the hardiest client! It can be a difficult piece of legislation to get to grips with, or even to recognise when you might have to worry about it. Our employment specialists are used to guiding their clients through TUPE. They can help you find practical solutions to the commercial problems of dealing with TUPE.
When might TUPE apply?
- On the transfer of a business e.g. on the sale of assets (but not shares)
- On the outsourcing of services (either on or off-shore)
- On a change of contractor providing dedicated services
- When services being carried out by a contractor are brought back in-house
What is the effect of TUPE?
- There is an obligation to inform and consult with employee representatives
- Employees automatically transfer on their existing terms and conditions
- Any employment liabilities also transfer automatically
- If employees are dismissed because of the transfer they will be able to bring a claim for unfair dismissal
- Certain information about the employees has to be provided to the new employer
