CC final report on the Sky/ITV inquiry
10 January 2008
Last May, the Secretary of State for Trade and Industry referred British Sky Broadcasting (Sky’s) acquisition of a 17.9 per cent share in ITV plc to the Competition Commission for a full investigation.
In its final report, the Competition Commission found that the merger is likely to result in a substantial lessening of competition in the all-TV market (pay TV and free to air services). Overall, the merger may be expected to operate against the public interest, although the media public interest would not be adversely affected.
The Competition Commission recommended that Sky should reduce its share in ITV to below 7.5% and undertake not to seek or accept representations on ITV’s board.
The Secretary of State will make a final decision on the media public interest consideration and remedies by the end of January.
