Do you want to challenge the accuracy of the claims being made by your competitors in their in advertising? Is one your competitors "knocking" your business in its promotional materials? If so one of your options may be to file a complaint with the Advertising Standards Authority (ASA).
The ASA through its "legal, decent, honest and truthful" campaign is well known in its role for protecting the interests of consumers against misleading advertising. What is less well known is its role in ensuring a level playing field between advertisers. The advertising codes which are enforced by the ASA contain restrictions and guidance on comparative advertising as well as restrictions on denigration of a competitor products or services. These rules supplement the rules relating to the use of someone else's trade marks.
