Restructuring

When companies are under performing and become financially distressed, this need not be fatal to the survival of the company or its business. There are often solutions to turn the business around or to achieve a restructuring of some or all of the business. This can involve the use of formal insolvency procedures such as company voluntary arrangements and administration.

Our team regularly works with under performing businesses, insolvency practitioners and turn around professionals together with our banking and corporate finance teams in order to firstly try and achieve a solvent restructuring of the business. If this proves impossible, we will consider and advise on a strategy to achieve an insolvent restructuring.
We have particular expertise in the restructuring of large retail property portfolios where the profitable core stores are retained through a solvent business and the non-core stores are closed and creditors’ claims dealt with through an insolvency process such as administration and company voluntary arrangements.

Charles Williams and Kate MacLeod advised us on the purchase of the business and assets of a Leeds based manufacturing business out of administration. The advice, support and all round communication was first class considering the extremely tight timescales involved with the transaction. The dedication and knowledge of the team at Shoosmiths is to be envied by the legal profession and we are in no doubt that they will be the first choice of advisors for future transactions.
