Residential landlord & tenant disputes
Our 15 strong national property litigation team is one of the largest and most experienced teams in the UK, specialising in the full range of landlord and tenant litigation. With clients operating in all sectors of the economy, the size of the team means that we have the strength in depth to provide comprehensive advice on all types of property dispute.
On the residential side we have considerable experience in dealing with long leasehold disputes. We regularly advise managing agents, residential management companies (RMC’s), institutional landlords and individuals regarding the recovery of service charges, the enforcement of lease covenants (including nuisance and disrepair claims) and on the exercise of the Right to Manage.
The team acts as honorary legal adviser to the Association of Residential Managing Agents (ARMA), and regularly contributes to its regional seminars and updates. We also work with the other associations interested in this sector, including the Association of Retirement Housing Management (ARHM).
We also have a significant track record in dealing with short term residential lettings, including the recovery of possession of properties let under assured shorthold tenancies. We provide a portfolio management service to a number of national retailers in relation to their residential units. However thoroughly a new tenant is vetted it is inevitable that, from time to time, landlords will experience difficulties with tenants failing to pay their rent, creating a nuisance, causing damage to the property, or refusing to move out at the end of the term of their tenancy.
