Mediation & arbitration
Gone are the days when suggesting mediation is seen as a sign of weakness. There is now a positive obligation on parties to explore alternative methods of resolving their disputes. In fact there are very few instances when Alternative Dispute Resolution ("ADR") is not appropriate.
We have experience of all forms of ADR whether that be a formal process like arbitration or adjudication, a consensual process like mediation or more imaginative options such as executive mini-trials.
More of our clients are choosing ADR as they believe it provides them with greater certainty, more control, flexibility, confidentiality and often can be organised within a matter of weeks or even days. Indeed a recent survey suggests that three quarters of the members of the Institute of Directors say they prefer to use ADR.
From the outset we will work with you to identify which dispute resolution method will best achieve your objectives. We will then guide you through the process as quickly and cost effectively as possible.
