Warranty claims
Corporate transactions lead to a variety of disputes from breach of warranty and indemnity claims and rectification issues through to misrepresentation and fraud. These disputes are also often subject to short contractual time limits so the early identification and resolution of these cases is key.
Our litigators act for buyers and sellers across all sectors. We understand the issues from both sides of the fence. We liaise closely with forensic accountants who can work with us in house to deliver clear and firm advice as to how to value the claim and how to proceed.
To give you a flavour of our experience, we recently successfully defended warranty claims against sellers of a travel business which had led to the purchasers withholding delayed consideration. Consideration in its entirety was recovered.
