Settlement in sight for young boy injured on bouncy castle

A young boy suffered a fracture to his neck following an accident on a bouncy castle and settlement is in sight after Shoosmiths took his case on a no-win-no-fee basis.

What we did

Master S was injured in an accident in June 2007 at a pub whilst playing on a bouncy castle.
 
We took the case on a on a no-win-no-fee agreement, and persuaded the pub landlord to accept responsibility for Master S’ accident. 

Background

Master S and his family had stopped at the pub for food following a day out at the zoo. A bouncy castle had been inflated in the pub garden, and Master S joined other children who were playing on it.

After just a few moments, Master S had been bounced over the side of the bouncy castle, which was approximately 8ft high, falling to the ground on the other side.

Master S, who was six at the time, fractured his neck and was rushed to hospital by ambulance. He had to lie flat for five days and wore a brace for 12 weeks to stabilise his neck.   

Master S’ accident was caused by older, boisterous children charging back and forth on the bouncy castle making it rock from side to side.

The pub had placed no safety matting around the base of the bouncy castle, nor had it organised any sort of supervision, or enforced any safety procedures; for example, putting an age restriction on those children allowed to play on it.

The pub landlord finally agreed to compensate Master S, and he is now undergoing further investigations to make sure the fracture of his neck has fully healed.
