Biker’s £10,000 claim settled within 18 months of accident

Shoosmiths gained a very satisfactory financial settlement for a motorcyclist without having to resort to court proceedings, after taking his case on a no-win-no-fee basis.

What we did

Shoosmiths settled our client’s claim for £10,176 by way of negotiated settlement.

This was achieved despite the other party’s insurers raising several issues concerning the financial losses incurred, including the pre-accident value of his motorcycle and the salvage charges.

Upon receipt of the final medical evidence, the defendant’s insurers made an offer to settle our client’s claim in the sum of £4,500, in November 2008.

We advised our client to reject this offer, and negotiations then took place resulting in our client’s claim being settled within a month of the original offer, and in the considerably higher sum of £10,176.

Background

Our client sustained a fracture to his left ankle. The majority of his symptoms had resolved in four to six, and he was left with ongoing symptoms which were a nuisance, but did not prevent him from working, or doing household chores or leisure activities. 

Prior to settlement an interim payment was obtained during the early stages of the case to cover our client’s financial losses, including the pre-accident value of his vehicle. This was despite the other party’s insurers raising issues concerning the value of the vehicle.

Medical evidence was obtained from an orthopaedic expert, which was disclosed to the other party’s insurers.
