Settlement for both driver and passenger

Our client was driving his vehicle with a passenger when the third party collided with our clients’ vehicle. Liability was admitted early on in the case, and Shoosmiths gained a very satisfactory financial settlement for the both the driver and passenger.
What we did
Both our clients sustained physical injuries as a result of the accident. We arranged for them to be examined by a medical expert, who in turn produced a medical report enabling us to value their injuries and arrange treatment recommended by the expert.
Background
Once liability was admitted by the third party insurers we proceeded to obtain the medical evidence to support our clients’ injuries.
The expert found that the driver sustained whiplash injuries to his neck, which were only 75% attributable to the accident. He advised that these injuries would resolve within six months from the date of the accident.
The third party offered £1,275 to settle his injuries claim. However, after further negotiations with Shoosmiths, they agreed to settle for £1,500 and £35 for miscellaneous expenses not supported by documentary evidence.
The expert found the passenger had sustained whiplash injuries to her neck, advising that they would resolve within three weeks of the date of the accident; and lumbar strain, which would resolve within six to seven months from the date of the accident.
The third party offered to settle her injuries claim at £1,550 and £25 for miscellaneous expenses not supported by documentary evidence. We advised our client to settle for this amount, as it was a reasonable offer.
