Client’s post-traumatic stress disorder after accident

Our client was a front seat passenger in her daughter’s vehicle travelling on the dual-carriageway when a pick-up truck drove across the central reservation and hit their car head-on. The driver of the truck then drove off.

What we did

The defendant was convicted of driving without due care and attention, failing to stop, failing to report an accident, and driving without a licence or insurance. 

Liability was subsequently admitted during civil proceedings. The parties reached an amicable settlement of the claim in favour of the claimant in excess of £30,000.

Background

Our client’s symptoms were principally psychological, and were significant enough for her to resign from her pre-accident employment.

She was diagnosed with post-traumatic stress disorder, and cognitive behavioural therapy was recommended to treat her symptoms and ongoing travel anxiety. It was expected that with treatment our client’s symptoms would improve considerably over a 12-month period, and no long-term psychological difficulties were envisaged.
