Pedestrian on central reservation hit by car

Our client was crossing the road to a central reservation and had one foot on its kerb when he was hit by a vehicle.

What we did

Liability was disputed from the outset, and it was argued that our client should not have crossed the road, as it was unsafe to do so.

The counter argument said the driver of the vehicle should have taken more care in his approach and given warning to our client crossing the road. The driver could have slowed down and avoided the collision.

Liability was admitted by the driver.

Background

As a result of the collision our client was taken to hospital. Fortunately, he did not sustain any fractures or broken bones, but did have severe facial injuries, including to his temple, which required stitches; and a laceration to his ear, resulting in tissue loss and necessitating plastic surgery. He also sustained whiplash type injuries. 

Having obtained medical evidence from an orthopaedic consultant and a plastic surgeon, reports confirmed a good recovery.

Our client received £23,000 damages.
