Damages recovered for injured party in towing incident
14 July 2009
Our client successfully recovered damages for injuries and financial losses caused in a towing incident, where liability was in dispute between the two Defendants.
What we did
We obtained medical evidence from suitably qualified experts to examine our client and prepare medico-legal reports outlining our client’s injuries and symptoms, together with providing an opinion and prognosis.
As liability was in dispute between the two Defendants, we secured an agreement for one Defendant to deal with our client’s claim and thereafter seek a contribution or indemnity from the other Defendant upon conclusion of liability discussions. Thereafter, we successfully negotiated settlement with the Defendant’s solicitors.
Background
This incident occurred when our client’s vehicle broke down, and a vehicle recovery service came to collect the vehicle. Our client’s vehicle was in a parking space and the recovery vehicle was parked on the opposite side of the road, with the winch cable crossing the carriageway. Our client was sat in his vehicle and as the recovery vehicle began towing our client’s vehicle towards it, a bus travelling along the road drove into the winch cable, causing our client’s vehicle to be propelled at speed and into the side of the bus.
