Lady with conversion disorder awarded £45000

Shoosmiths obtained compensation for Ms N who suffered orthopaedic injuries and conversion disorder after accident in which her car was hit from the side at high speed.

What we did

Ms N suffered injuries indicative of a head injury, including the unusual symptom of her developing a South African accent. She also had slurring of speech, difficulty in concentration and short term memory problems.

The various symptoms required evidence from a range of consultants and Shoosmiths arranged evidence from an orthopaedic and maxillofacial consultant as well as evidence from a neurologist and neuropsychologist.

The evidence indicated that Ms N was suffering from, amongst other things, conversion disorder (a somatic condition where the Claimant genuinely believed that they had neurological and brain function symptoms, but for there was no objective root cause).

Further evidence had to be obtained to deal with issues raised as to the veracity of Ms N’s complaints given surveillance evidence, in order that the other party’s insurer accepted the medical evidence and made offers to settle.

Interim payments for counselling and physiotherapy were obtained to assist the Claimant’s recovery and evidence was obtained to show that the injuries sustained were sufficient to cause Ms N to lose earnings.

A negotiated settlement which was favourable to Ms N was then achieved.
