Motorcyclist injured whilst filtering past stationary traffic

Our client was a motorcyclist who was injured whilst filtering past stationary traffic when a third party vehicle pulled out of a car park directly in front of our client’s path of travel.
What we did
We obtained compensation for our client in respect of financial losses and personal injuries, including a fracture of the right distal tibia requiring manipulation under anaesthesia and a deep laceration to right leg requiring suturing.
Background
Our client was riding his motorcycle and filtering past stationary traffic when a third party vehicle pulled out of a car park to our client’s left, intending to turn right. A collision occurred.
Our client sustained a fracture of the right distal tibia requiring manipulation under anaesthesia and a deep laceration to right leg requiring suturing.
Medical evidence confirmed that our client would have a predisposition to arthritis which would be brought forward by a period of at least 10 years compared to the normal population.
A claim was also made for disadvantage on the labour market.
Compensation was obtained in the total sum of £17,750, although our client only received 50% of this agreed value as he was deemed to be 50% responsible for the accident because he was filtering past stationary traffic in an unsafe manner.
