Jim leads Shoosmiths' national unsecured lending litigation and recoveries unit which acts for lenders and debt purchasers providing volume recoveries services for unsecured consumer lending products and guarantee. The unit also provides bespoke advice on defended and complex claims using one case management system, allowing collated management information, under one management structure.
Jim acts for a number of lenders and debt purchasers advising them on a wide range of banking, lending and security issues. He works closely with those clients to design and implement innovative and cost effective recoveries strategies in an increasingly regulated environment.
Jim also advises lenders and debt purchasers on claims against them including, for example, issues arising under consumer credit legislation, security issues, and restitutionary claims.
Recent experience includes:-
- designing and implementing an innovative process for the recovery of mistaken payments for a leading UK bank;
- advising a leading bank on issues in relation to the content and form of default notices under the CCA;
- assisting a leading lender in re-designing its complaints management process to reflect the changing regulatory environment.
Jim joined Shoosmiths as a trainee in 1996, qualified in 1998 and became a partner in 2006. Jim, therefore, has over 17 years experience in dealing with recoveries litigation.
