Our Consumer Finance Litigation & Recoveries Team operates in all jurisdictions within the UK providing a comprehensive recoveries and litigation service for the recovery of secured and unsecured consumer lending products, including consumer credit products, residential and buy-to-let mortgages, and mortgage shortfall.
Our clients include clearing banks, other retail banks, building societies, other consumer finance lenders and debt purchasers.
Shoosmiths is authorised by the FCA for, amongst other things, debt collection, debt administration, and mortgage administration. Alongside our authorisation by the SRA, our FCA authorisation ensures that, like our clients, we focus on conduct risk and the customer journey ensuring that each individual customer is treated fairly.
We deploy specialist teams for both unsecured and secured consumer debt including mortgage shortfall and locally qualified solicitors in each jurisdiction with detailed knowledge and experience of their local markets.
We provide pre-litigation engagement services (for both secured and unsecured debt) with the aim of avoiding litigation wherever possible and identifying appropriate and sustainable solutions for each customer to repay their debt.
Where litigation is necessary, our teams use our sophisticated case management system (the same system being used across debt types and jurisdictions) to deliver an efficient and compliant service to our clients. Our systems permit the collection of relevant data and its presentation to clients as they require.
Our standard litigation teams are supported by teams of qualified solicitors and senior paralegals who provide technical support embedded within each team ensuring that complex matters are dealt with appropriately, protecting our clients’ interests and reputation at all times.
By providing the same service for secured and unsecured lending across England and Wales, Scotland and Northern Ireland under a single management structure and on one case management system, we are able to support our clients’ aims and objectives to ensure that their outsourcing is delivered to a high and consistent level throughout the UK.
Clients benefit from being able to undertake oversight (and, therefore, meet one of the FCA’s expectations) of one supplier who deploys a single 3 lines of defence model delivering appropriate and consistent outcomes to its clients’ customers.
As well as our focus on recoveries and recoveries litigation, we also have an extensive track record supporting our clients in a range of consumer finance disputes including such areas as s75 claims, mandate disputes, title rectification and other security issues.
We work with our clients to design, and keep under review, all strategies being deployed to ensure that they are effective and remain fit for purpose both from a commercial and regulatory perspective.
This approach to continuous improvement ensures that we work in partnership with clients and is reflected in the many long standing relationships we have with clients which have endured over many years of commercial and regulatory change.
